Terms & conditions – Leathercraft by Jojo
1. General
1.1 These general terms and conditions apply to all offers of “Leathercraft by Jojo” and to all agreements concluded with our customers.
2. Ordering
2.1 Orders can be placed via the website or via e-mail.
2.2 The agreement is concluded when “Leathercraft by Jojo” has processed your order after receiving your payment.
3. Prices
3.1 The prices on the website are the current prices.
3.2 As long as the agreement has not been concluded, “Leathercraft by Jojo” is authorized to change the prices and conditions stated on the website.
3.3 All prices are inclusive of VAT, exclusive of costs of packaging, transport, shipping and any statutory contributions unless stated otherwise.
3.4 “Leathercraft by Jojo” is also authorized to pass on changes to the rate of sales tax and any other taxes and / or levies after the agreement has been concluded.
4. Delivery
4.1 “Leathercraft by Jojo” determines the mode of transport and the carrier. If you have special transport requirements, the extra costs are for your account. All orders are delivered to the specified address.
4.2 A one-off contribution to the shipping costs stated on the website will be charged per order.
4.3 “Leathercraft by Jojo” strives to deliver your order within 3 weeks. In case of delay, you will receive a message about this within two weeks after the acceptance of your order from “Leathercraft by Jojo”. You then have the right to cancel the order free of charge within 7 days of receipt of the delay notice. If this cancellation does not take place (on time), you are deemed to agree to the delay.
4.4 If part of the order can only be delivered later, the same applies. No additional costs are associated with subsequent delivery.
4.5 If delivery of an article turns out to be impossible for whatever reason, “Leathercraft by Jojo” will try to deliver an article comparable in price and quality in consultation with you.
4.6 Despite all the care that we take with orders, it is possible that an order is not delivered or is incomplete. In that case, you can report this to us up to 7 days after receipt of your order and the delivery will be supplemented or redone at our expense.
5. Payment
5.1 Payments can only be made in advance at Postbank number 1019560, quoting the order number.
5.2 If a payment is not on our account 14 days after the order, we will cancel this order.
6. Returns
6.1 Return shipments can only be made within 10 working days via a written request (e-mail) to “Leathercraft by Jojo”.
6.2 We only accept returns for warranty claims (see point 7) and incorrect deliveries, not for custom made products.
6.3 In the event of warranty claims and incorrect deliveries, “Leathercraft by Jojo” will reimburse the shipping costs
6.4 All return shipments must be sent in the original packaging accompanied by a copy of the relevant invoice in proper shipping packaging.
7. Warranty
7.1 A limited warranty applies to our products. Manufacturing defects must be reported in writing to “Leathercraft by Jojo” within 1 month of receipt of the order.
7.2 A warranty period of 12 months applies to manufacturing defects for our products. Warranty claims must be reported in writing to “Leathercraft by Jojo” within 14 days after discovery of the defect.
7.3 This guarantee means that if the conditions set out in 7.1 and 7.2 are met, “Leathercraft by Jojo” will repair or replace the article (at the option of “Leathercraft by Jojo”) without the costs being passed on to you. If the article cannot be repaired and replacement is not possible because the article is no longer available, “Leathercraft by Jojo” offers you the option to offer a replacement article or to return your purchase amount (with the exception of the shipping costs).
7.4 This warranty does not apply if:
– The article is insufficiently protected against transport damage in the event of return.
– You have made changes to the item.
– There are defects that are caused by incorrect or improper use.
– The defect was caused by intent or gross negligence.
– There is talk of an external calamity, such as lightning strike, floods, natural disasters, etc.
– “Leathercraft by Jojo” has not been given the opportunity (in time) to investigate the complaint and possibly repair the defect.
7.5 Excluded from the warranty are consumables.
8. Personal data
8.1 Your personal data will be stored in the “Leathercraft by Jojo” customer system in order to process the orders.
8.2 Your data will not be used for marketing purposes.
8.3 “Leathercraft by Jojo” will never provide your information to third parties and guarantees your privacy. (detailed information in our privacy policy)
9. Liability
9.1 The liability of “Leathercraft by Jojo” with regard to the sale and delivery of products is expressly limited to the guarantee regulated under 7.
9.2 Any liability of “Leathercraft by Jojo” is limited to the amount of the relevant invoice sent.
10. Disputes
10.1 These general terms and conditions are governed by Dutch law.
Algemene voorwaarden – Leathercraft by Jojo
1. Algemeen
1.1 Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen van ‘Leathercraft by Jojo’ en op alle met onze afnemers gesloten overeenkomsten.
2. Bestellen
2.1 Bestellingen kunnen geplaatst worden via de website of via e-mail.
2.2 De overeenkomst komt tot stand op het moment dat ‘Leathercraft by Jojo’ uw bestelling in behandeling heeft genomen na het ontvangen van uw betaling.
3. Prijzen
3.1 De prijzen op de website zijn de actuele prijzen.
3.2 Zolang de overeenkomst niet tot stand is gekomen is ‘Leathercraft by Jojo’ bevoegd om de op de website vermelde prijzen en voorwaarden te wijzigen.
3.3 Alle prijzen zijn inclusief BTW, exclusief kosten van verpakking, vervoer, verzending en eventuele wettelijke bijdragen tenzij anders vermeld staat.
3.4 ‘Leathercraft by Jojo’ is ook na het tot stand brengen van de overeenkomst bevoegd wijzigingen in het tarief van de omzetbelasting en eventuele andere belastingen en/of heffingen aan u door te berekenen.
4. Levering
4.1 ‘Leathercraft by Jojo’ bepaalt de wijze van vervoer en de vervoerder. Indien u bijzondere vervoerswensen heeft, komen de extra kosten voor uw rekening. Alle bestellingen worden op het opgegeven adres afgeleverd.
4.2 Per bestelling wordt éénmalig een op de website vermelde bijdrage in de verzendkosten in rekening gebracht.
4.3 ‘Leathercraft by Jojo’ streeft er naar uw bestelling binnen 3 weken af te leveren. Bij vertraging ontvangt u hierover uiterlijk binnen twee weken na de acceptatie van uw bestelling van ‘Leathercraft by Jojo’ bericht. U heeft dan het recht om uiterlijk binnen 7 dagen na ontvangst van het vertragingsbericht de bestelling zonder kosten te annuleren. Vindt die annulering niet (tijdig) plaats, dan wordt u geacht in te stemmen met de vertraging.
4.4 Indien een gedeelte van de bestelling pas later kan worden geleverd, geldt hetzelfde. Aan nalevering zijn geen extra kosten verbonden.
4.5 Indien levering van een artikel om welke reden dan ook niet mogelijk blijkt te zijn, zal ‘Leathercraft by Jojo’ in overleg met u trachten een zowel in prijs als kwaliteit vergelijkbaar artikel te leveren.
4.6 Ondanks alle zorgvuldigheid die wij bij bestellingen in acht nemen, kan het voorkomen dat een bestelling niet of onvolledig wordt geleverd. In dat geval kunt u dit tot 7 dagen na ontvangst van uw bestelling bij ons melden en wordt de levering eventueel op onze kosten aangevuld of opnieuw gedaan.
5. Betaling
5.1 Betalingen kunnen uitsluitend vooraf op Postbank nummer 1019560 onder vermelding van het bestelnummer.
5.2 Indien een betaling 14 dagen na de bestelling niet op onze rekening staat annuleren wij deze bestelling.
6. Retourzendingen
6.1 Retourzendingen kunnen uitsluitend binnen 10 werkdagen via een schriftelijke aanvraag (e-mail) bij ‘Leathercraft by Jojo’.
6.2 Wij accepteren alleen retourzendingen bij garantieclaims (zie punt 7) en foutieve leveringen, niet voor maatwerk.
6.3 In het geval van garantieclaims en foutieve leveringen zal ‘Leathercraft by Jojo’ de verzendkosten vergoeden
6.4 Alle retourzendingen dienen in de originele verpakking vergezeld van een kopie van de betreffende factuur in deugdelijke verzendverpakking verstuurd te worden.
7. Garantie
7.1 Voor onze produkten geldt een beperkte garantie. Fabricagefouten dienen binnen 1 maand na ontvangst van de bestelling schriftelijk bij ‘Leathercraft by Jojo’ gemeld te worden.
7.2 Voor onze produkten geldt een garantie termijn van 12 maanden op fabricagefouten. Garantieaanspraken dienen binnen 14 dagen na ontdekking van het gebrek schriftelijk bij ‘Leathercraft by Jojo’ gemeld te worden.
7.3 Deze garantie houdt in dat indien aan de in 7.1 en 7.2 gestelde voorwaarden is voldaan, ‘Leathercraft by Jojo’ het artikel repareert of vervangt (ter keuze van ‘Leathercraft by Jojo’) zonder dat de kosten ervan aan u worden doorberekend. Indien het artikel niet te repareren is en vervanging niet mogelijk doordat het artikel niet meer leverbaar is, biedt ‘Leathercraft by Jojo’ u de mogelijkheid om een vervangend artikel aan te bieden of uw aankoopbedrag te retourneren (met uitzondering van de verzendkosten).
7.4 Deze garantie is niet van toepassing indien:
• Het artikel bij retourzending onvoldoende wordt beschermd tegen transportschade.
• U wijzigingen aan het artikel heeft aangebracht.
• Sprake is van gebreken die ontstaan zijn door foutief of onoordeelkundig gebruik.
• Het gebrek is ontstaan door opzet of grove onachtzaamheid.
• Sprake is van een van buiten komend onheil, zoals blikseminslag, overstromingen, natuurrampen, enz.
• ‘Leathercraft by Jojo’ niet (tijdig) in de gelegenheid is gesteld voor onderzoek van de klacht en het eventueel herstellen van het gebrek.
7.5 Uitgesloten van garantie zijn verbruiksartikelen.
8. Persoonsgegevens
8.1 Uw persoonlijke gegevens worden in het klantensysteem van ‘Leathercraft by Jojo’ opgeslagen om de bestellingen te verwerken.
8.2 Uw gegevens worden niet gebruikt voor marketingdoeleinden.
8.3 ‘Leathercraft by Jojo’ zal uw gegevens nooit aan derden verstrekken en waarborgt uw privacy. (uitgebreide informatie in ons privacybeleid)
9. Aansprakelijkheid
9.1 De aansprakelijkheid van ‘Leathercraft by Jojo’ met betrekking tot de verkoop en levering van produkten is uitdrukkelijk beperkt tot de onder 7 geregelde garantie.
9.2 Iedere aansprakelijkheid van ‘Leathercraft by Jojo’ is beperkt tot het bedrag van de terzake verzonden factuur.
10. Geschillen
10.1 Op deze algemene voorwaarden is Nederlands recht van toepassing.
